Home / Glossary / Section 8 notice

What is Section 8 notice?

A section 8 notice tells an assured tenant that the landlord intends to seek possession on one or more legal grounds, such as rent arrears, selling the property or the landlord moving in.

Why it matters to landlords

Some grounds are mandatory, meaning the court must grant possession if the ground is proved, and others are discretionary. Each ground has its own notice period and evidence requirements.

Notices must use the prescribed form and be served correctly. Mistakes can mean starting again, so many landlords take advice before serving.

Rent arrears, anti social behaviour and the landlord selling or moving in are among the most used grounds.
