What is Joint ownership and Form 17?

When a rental property is jointly owned, each owner reports their own share of the income and expenses. Married couples and civil partners are taxed 50:50 by default, unless they own unequal shares and send HMRC Form 17.

Why it matters to landlords

Form 17 declares that you really own the property in unequal beneficial shares, backed by evidence such as a declaration of trust. HMRC must receive it within 60 days of the declaration being signed, and it only works from that date.

Unmarried joint owners are taxed on their actual shares without Form 17. For Making Tax Digital, each owner uses their share of the gross rent when working out qualifying income.

Example

A couple own a let 90:10 under a declaration of trust. Without Form 17 they are taxed 50:50. With it, the 90% owner reports 90% of the profit.
